Madam Speaker, I believe you will give me my right as a Member who prepared a minority report that was co-signed by two other Members: Hon. Adeke Ann Ebaju for FDC, District Woman Representative for Soroti and Hon. Asuman Basalirwa, the MP for Bugiri Municipality. Madam Speaker, our points of dissent are in the following areas; 1. The provisions in the Bill that tend to infringe the freedom of expression contrary to Article 29 of the Constitution. 2. The inconsistent mens rea since several offenses of comparable severity, particularly Clauses 8 – incidentally this particular microphone seems to have been tampered with and mine has – Clauses 8, 10, 12, and 22 that remain strict liability while others require intention or knowledge and creating an internal inconsistency contrary to Article 28(3) of the Constitution. I hope the Hansard will capture me.

Thank you very much, Madam Speaker. I would like to find out from the Prime Minister when the implementation of the USMID programme in Bugiri Municipality is commencing. Madam Speaker, I am aware that there is government support to municipalities, which extends to constructing tarmac roads and street lighting for municipalities; it is a special government programme. It has been implemented in other municipalities, and I would like to find out when it is coming to Bugiri, because as you are aware, Bugiri is the first important town as you enter Uganda from the other side of the country. So, it is an embarrassment for it not to be benefiting from the municipality.

Let me tell you, honourable members, when you put your questions in writing, you will find that the Prime Minister will take her time to get responses from each and every ministry on the questions. However, when you raise them here, you may not get all that you need. So, let us put them down in writing and they will respond to them, one by one, and what action has been taken. Honourable members, in the public gallery this morning, we have a delegation of the executive of Bugiri Municipality, led by the Mayor, Mr Ayub Kisubi. You are welcome. (Applause) They are represented by Hon. Agnes Taaka and Hon. Asuman Basalirwa. Hon. Basalirwa, stand up and come here. First greet them. (Laughter) You are most welcome; you have a very good Member of Parliament. If it is even possible, he should come back unopposed. (Laughter) Honourable members, you will allow me to invoke my powers, under rule 25, to amend the Order Paper and we get a motion from the Minister of Education and Sports. It will be moved by the minister, under Rule 56 of the Rules of Procedure, to establish the National Institute for Teacher Education. While we are doing all this, if we finish the tax Bills today, the next sitting will be on appropriation. How I wish the Minister of Finance, Planning and Economic Development could declare early in case they will have a corrigendum, so that this House allows us to refer it administratively, other than calling you back from your villages. We will refer to it and ratify on the day when we are sitting. So, honourable minister, do you have something – (Hon. Odur rose_) Is it on the same?

Thank you, Madam Speaker. The other day, you talked about the floods and the minister said that he would be coming here with a statement. I am not seeing the minister here but maybe the Government Chief Whip will do that because we addressed it as a matter of urgency. More importantly, this Parliament appropriated and we have received the Shs 1 billion for the districts and municipalities; Bugiri Municipality equally received it. However, there is information from the ministry that that money is specifically for murram roads and has nothing to do with tarmac. Some municipalities were prepared to use that money to do tarmacking - (Interruption) We seek clarification from the Government specifically on the modus operandi in as far as that Shs 1 billion is concerned, especially where a road committee sits and takes a decision.

13234 THE VALUE-ADDED TAX (AMENDMENT) BILL, 2024 comprehensive taxation policy in Uganda. This concern stemmed from the realisation that the Domestic Revenue Mobilisation Strategy formulated by the Ministry of Finance, Planning and Economic Development in 2020 lacked a well-documented taxation policy. Consequently, Parliament on the same day, 5 May 2020, passed a motion, urging the Government to develop a comprehensive policy on taxation. Unfortunately, up to now, this Government, every financial year, introduces tax Bills without a taxation policy in place. This approach grants this Government unchecked discretion in determining which taxes to impose, which amounts, timing and targets. Often, this leads to unfair taxation that disproportionately burdens the impoverished citizenry. During the debate, one of the Members who has now signed the majority report, Hon. Dickson Kateshumbwa, former Commissioner for Domestic Taxes, stated - and I want to quote here what he stated – that “we need to base our tax decisions on a structured policy rather than relying on ad hoc negotiations. This approach will enable us to uphold the principles we aim for and foster investment within our country.” That is what Hon. Kateshumbwa said here. I do not know which Kateshumbwa has now signed the majority report. (Laughter) Hon. Asuman Basalirwa, President of JEEMA and MP for Bugiri Municipality, echoed similar sentiments, emphasising that effective legislation on taxation is typically preceded by a well-established policy framework. He highlighted the existence of numerous taxation laws that lack proper policy guidelines. Madam Speaker, in the absence of such a comprehensive taxation policy, the hands of this Parliament are tied. The solution is to ask the Government to withdraw their Bills and return them when they are ready. I do not know how long you want to continue babysitting adults like Hon. Kasaija, Hon. Musasizi and company because you made a proposal and told them “Go and do these things”. They have now returned without doing them; they are saying, “Go ahead –

7621 THE ELEVENTH PARLIAMENT OF UGANDA TUESDAY, 21 MARCH 2023 time and referred to the Committee on Legal and Parliamentary Affairs, for scrutiny. The Bill is a Private Member’s Bill, sponsored by Hon. Asuman Basalirwa, MP for Bugiri Municipality. The object of the Bill is to establish a comprehensive and enhanced legislation to protect the traditional family by – (a) prohibiting any form of sexual relations between persons of the same sex and the promotion or recognition of sexual relations between persons of the same sex; (b) strengthening the nation’s capacity to deal with emerging internal and external threats to the traditional heterosexual family. This legislation further recognises the fact that same-sex attraction is not an innate and immutable characteristic; (c) protecting the cherished culture of the people of Uganda, legal, religious and traditional family values of Ugandans against the acts of sexual rights activists seeking to impose their values of sexual promiscuity on the people of Uganda; and (d) protecting children and the youth who are made vulnerable to sexual abuse through homosexuality and related acts. The Bill seeks to address the gaps in the provisions of other laws in Uganda, for example, the Penal Code Act, Cap. 120, which has no comprehensive provision that caters for homosexuality and majorly focuses on unnatural offences under section 145, and lacks provisions for penalising the procurement and promotion, dissemination literature and other pornographic materials concerning the offences of homosexuality. As a result, there is need for a legislation to enhance offences relating to homosexuality and clear provisions for charging, investigating, prosecuting, convicting and sentencing offenders. The legislation seeks to supplement the provisions of the Constitution of the Republic of Uganda and the Penal Code Act, Cap. 120 by criminalising same-sex marriages. Article 31 of the Constitution recognises that men and women of the age of 18 years and above have the right to marry and to found a family and are entitled to equal rights in marriage, during marriage and at its dissolution. In the same vein, the Constitution recognises the cultural diversity of Uganda and, Article 37 of the Constitution recognises every person’s right to belong to, enjoy, practice, profess, maintain and promote any culture, cultural institutions, language, tradition, creed or religion in community with others. The Constitution of the Republic of Uganda contains, in Chapter Four, a Bill of Rights, which guarantees and protects a number of rights and freedoms. The rights recognised and protected in the Constitution are enjoyed by all persons in Uganda. The Constitution of Uganda does not recognise the right to homosexuality, but bans and prohibits same-sex marriages. Uganda enjoys a rich cultural diversity and, although all are richly different, they do not recognise same-sex relations. Whereas some few individuals have existed with such tendencies, these were isolated by society and, in some cases, punished for such unnatural acts. The prohibition against homosexuality is entrenched in the laws of Uganda and our cherished and shared cultural norms and values. Whereas homosexuality, as an offence, already exists on the law books under the Penal Code Act, there is need to redefine the law, placing emphasis on the new and emerging matters, which are not contained in the Penal Code Act such as the promotion of homosexuality and the recruitment of children into homosexuality, which have been blamed for the rising incidences of homosexuality in Uganda.

Thank you, well done, Chairman, and your team. Colleagues in the public gallery, we have a delegation of Bulesa Subcounty leaders from Bukooli County, Central Bugiri District. They are represented by Hon. Silwany Solomon and Hon. Taaka Agnes. They have come to observe the proceedings of this House. Please join me in welcoming them. Thank you. You can stand up for recognition. Chairperson, I have seen that you have touched on critical issues. But, colleagues, I think when it comes to the internet, how is it done? I think money is appropriated and then deducted at source and paid to the National Information Technology Authority - Uganda (NITA-U) to facilitate its work. So, for water, because the National Water and Sewerage Corporation, the money they get is the one they reinvest in extending water services to our rural areas. Now, here, we appropriate money, but when they release it to agencies, they do not remit it or find it as a priority - I think we need the ministry of finance here. Maybe, we should agree that for utilities, money should be directly deducted from the ministry for finance and directly. (Applause) Because this will take away the situation of knowing, if you cut off Luzira or Mulago, everyone will riot, and the same system should apply to electricity, seeing as Uganda Electricity Distribution Company Limited (UEDCL) is a Government company. I think it would work well if they can have money to go and support. Honourable colleagues, the debate is now open and I will start with the Hon. Bob Okae, followed by Hon. Bwanika, Dr Apio, Hon. Nabukenya Brenda, Hon. Adeke Ann, Hon. Nambooze, Hon. Allan, Hon. Nkunyingi, Hon. Acrobert, Hon. Julius, Hon. Batuwa, Hon. Solo Kayembe - for now, and then I move to the other side. Honourable colleagues, to avoid delays, etcetera, I usually do not take procedural matters. Hon. Bob, 3 minutes each.

Thank you, honourable minister, for giving way. There has been degeneration in this issue of education. You find in different districts, different politicians are now setting exams in their names and giving children the exams. You find, for example, that the person names it “Solomon Silwany Examinations Board”. They set the exams and administer them. It has happened in my district, Bugiri District Local Government. They set exams in a person’s name and administer them. I have seen it. Even party presidents of different political parties set exams.

I thank the minister for the report; however, the young women and girls had issues that I would like to put forward for the Government to intervene. They said that much as the Government has provided Universal Primary Education (UPE) and Universal Secondary Education (USE); some have failed to go back to school because of the fees charged in most schools almost to the level of private schools. Thank you, Mr Speaker. I thank you for according us time to talk about our brother, parent and grandparent. Honourable members have talked about the late Henry Kyemba, but I would like to bring out something that has not been said yet. When we were growing up and after university, when I went back to work in my home area, Bugiri District, there was a very beautiful, elegant and smart lady, who used to come with NGOs in our area to show us how to work because it was a new district. Thank you, Madam Speaker. On the 16 th of June, the country commemorated the Day of the African Child and Bugiri District had the opportunity to mark the same on the 6 th of July. The children raised a number of issues and I request that, after raising this matter, I lay their papers on Table for further scrutiny by this House, as you will guide. Madam Speaker, urgently, though, the children raised an issue of night fundraisings at vigils – during burial ceremonies. These are activities that take place at night vigils in most parts of Busoga, Bukedi and even Teso. I do not know about other parts that I am not familiar with -

A certified version of this Report can be obtained from the Office of the Clerk to Parliament. World Commemoration of Malaria in Bugiri District. We want to have a situation where we record zero cases of malaria, but that is only possible when we all get committed. Since I am making this presentation on behalf of the Deputy Speaker, I remember one day, he challenged all of us to be members of this forum. I now want to invite all of you to join the forum, as we join our efforts in the fight against malaria. Allow me wind up by saying that besides the Malaria Walk, we also have other activities organised for the day. We shall have blood donation; we have tasked the coordinator to engage one of the specialists in blood donation and have media coverage of them giving us the advantages of blood donation. If you have never donated blood, please come and save the lives of people in this country on the 23 rd . Across the country right now, we have challenges of blood shortage. We shall also have a medical camp on that day and a number of tests will be conducted here with treatment. In summary, those are the activities for that day of the Malaria Walk, but I am also inviting Members to participate in the commemoration of the World Malaria Day, come the 25 th of April this year. I thank you.

Thank you very much, honourable member for Bugiri District. Honourable minister, what the Member of Parliament is saying is that let us move away from single-carriage roads to dual ones in order to avoid the aspect of collision. And if you heard what the honourable minister said before, you notice that this accident occurred as a result of a collision. The driver of the other car just went to the side where Hon. Okabe was driving. If we have a dual carriage road, we could be able to avoid collisions of that kind. So, think about it as you come up with the next designs for roads.
