15321 THE ELEVENTH PARLIAMENT OF UGANDA WEDNESDAY, 27 NOVEMBER 2024 and decisions. Indeed, all the Members of Parliament have been very vigilant and active in this matter, all the 31 signed the report and there is no minority report. I, therefore, wish to read the report. On 18 April 2024, the Rt Hon. Speaker referred a petition by Tibet Hima Mining Company Limited against the alleged unfair termination of their Concession Agreement with the Government of Uganda to the Committee on Environment and Natural Resources for consideration, investigation, and report back. The petition was presented by Hon. Solomon Silwany, Member of Parliament for Bukooli County Central. The committee has considered the petition and I hereby wish to report. 2.0 Background On 6 September 2013, the Government of Uganda, represented by the Minister of Energy and Mineral Development, the Minister of Finance, Planning and Economic Development, and Kilembe Mines Limited (hereinafter referred to as “KML”) entered into a Concession Agreement with the Tibet Hima Mining Company Limited, the Petitioner and hereinafter referred to as “Tibet” or the “Petitioner”. The Concession followed a competitive international bidding process in which the Petitioner emerged as the best-evaluated bidder. Consequently, the Government accepted a proposal by the consortium led by Tibet Hima Automobile Industry Company Limited, and awarded the Concession to the Petitioner to revamp Kilembe Mines, which had been dormant for over 30 years. The Government of Uganda was desirous of encouraging further exploration and development of minerals in Uganda, as well as promoting and facilitating the operation of mining companies. It was hoped that this policy would benefit the regions and local communities in which minerals are developed through facilitating the growth of socio- economic infrastructure such as schools, health facilities, and clean water supply systems for sustainable regional and national development. 2.1 Kilembe Mines Limited Kilembe Mines Limited is a public enterprise listed under the Public Enterprise Reform and Divestiture Act, Cap. 78, also referred to as the PERD Act. Among the assets of Kilembe Mines Limited are the copper mine at Kilembe in Kasese District and also the 4.5 Megawatt Hydropower Plant at Mubuku. Tibet-Hima Mining Company is a subsidiary of Tibet Automobile Company of China and a special-purpose vehicle company specifically for carrying out the project under the concession agreement with the Government of Uganda. 2.3 Purpose of the Concession The purpose of the concession was for Tibet to revamp the mines at Kilembe, including their assets such as land, minerals, and mineral rights, which had to be done for a period of 25 years. At the time of execution of the Concession Agreement, the mineral rights held by Kilembe Mines Limited included Special Mining Lease 215, Special Mining Lease 3433, Exploration Licenses 1212, and Exploration License 1248. Under the Concession, KML granted Tibet the right to use the conceded assets in accordance with the terms of the Concession Agreement. The parties also entered into a deed assignment dated 23 December 2013 between KML and Tibet. The deed provided that upon termination of the Concession Agreement, the assigned exploration and mining leases were to revert to Kilembe Mines Limited. 2.4 Termination of the Concession Agreement On the 20 th day of June 2017, Hon. Evelyn Anite, Minister of State for Finance, Planning, and Economic Development, in charge of privatisation and investment, issued a notice of termination of the Concession Agreement to the Chief Executive Officer (CEO) of Tibet noting that in spite of the several notices of

Madam Speaker, what is important to emphasise to the minister is that before passing the resolution of this House, the House was aware of the guidelines previously issued by the works ministry. In fact, we had considered those guidelines issued by the works ministry but we noticed that they had become an obstacle to themselves. It was against that background that Parliament resolved to take the guidelines issued and approved by Parliament. Madam Speaker, the minister is saying that the local governments have two sets of guidelines. I think they just want to deliberately create confusion. The local governments are claiming that because they have two sets of guidelines they can choose which ones to follow. So, unless the minister gives clarification to the local governments – information from Bugiri – (Interjections) - yes, from the Member of Parliament for Bukooli County Central. (Applause)

Thank you, well done, Chairman, and your team. Colleagues in the public gallery, we have a delegation of Bulesa Subcounty leaders from Bukooli County, Central Bugiri District. They are represented by Hon. Silwany Solomon and Hon. Taaka Agnes. They have come to observe the proceedings of this House. Please join me in welcoming them. Thank you. You can stand up for recognition. Chairperson, I have seen that you have touched on critical issues. But, colleagues, I think when it comes to the internet, how is it done? I think money is appropriated and then deducted at source and paid to the National Information Technology Authority - Uganda (NITA-U) to facilitate its work. So, for water, because the National Water and Sewerage Corporation, the money they get is the one they reinvest in extending water services to our rural areas. Now, here, we appropriate money, but when they release it to agencies, they do not remit it or find it as a priority - I think we need the ministry of finance here. Maybe, we should agree that for utilities, money should be directly deducted from the ministry for finance and directly. (Applause) Because this will take away the situation of knowing, if you cut off Luzira or Mulago, everyone will riot, and the same system should apply to electricity, seeing as Uganda Electricity Distribution Company Limited (UEDCL) is a Government company. I think it would work well if they can have money to go and support. Honourable colleagues, the debate is now open and I will start with the Hon. Bob Okae, followed by Hon. Bwanika, Dr Apio, Hon. Nabukenya Brenda, Hon. Adeke Ann, Hon. Nambooze, Hon. Allan, Hon. Nkunyingi, Hon. Acrobert, Hon. Julius, Hon. Batuwa, Hon. Solo Kayembe - for now, and then I move to the other side. Honourable colleagues, to avoid delays, etcetera, I usually do not take procedural matters. Hon. Bob, 3 minutes each.

Thank you, honourable minister, for giving way. There has been degeneration in this issue of education. You find in different districts, different politicians are now setting exams in their names and giving children the exams. You find, for example, that the person names it “Solomon Silwany Examinations Board”. They set the exams and administer them. It has happened in my district, Bugiri District Local Government. They set exams in a person’s name and administer them. I have seen it. Even party presidents of different political parties set exams.

They said that much as the Government has provided Universal Primary Education (UPE) and Universal Secondary Education (USE); some have failed to go back to school because of the fees charged in most schools almost to the level of private schools. They request the Government to intervene in that matter. The other is the –

When we were growing up and after university, when I went back to work in my home area, Bugiri District, there was a very beautiful, elegant and smart lady, who used to come with NGOs in our area to show us how to work because it was a new district. She would have side sessions with us, young girls who had left the university and opted to work in the villages because, at that time, most girls wanted to work in Kampala. This lady created time and taught us how to speak, how to make your point clear and develop yourself as an individual, combine your office and work and be happy as a young mother or woman. Thank you, Madam Speaker. On the 16 th of June, the country commemorated the Day of the African Child and Bugiri District had the opportunity to mark the same on the 6 th of July. The children raised a number of issues and I request that, after raising this matter, I lay their papers on Table for further scrutiny by this House, as you will guide. I request the honourable members and members of the public to support the forum and spare something small to get their kits for the day so that we are smart. A certified version of this Report can be obtained from the Office of the Clerk to Parliament. World Commemoration of Malaria in Bugiri District. We want to have a situation where we record zero cases of malaria, but that is only possible when we all get committed. Since I am making this presentation on behalf of the Deputy Speaker, I remember one day, he challenged all of us to be members of this forum. I now want to invite all of you to join the forum, as we join our efforts in the fight against malaria. Allow me wind up by saying that besides the Malaria Walk, we also have other activities organised for the day. We shall have blood donation; we have tasked the coordinator to engage one of the specialists in blood donation and have media coverage of them giving us the advantages of blood donation. If you have never donated blood, please come and save the lives of people in this country on the 23 rd . Across the country right now, we have challenges of blood shortage. We shall also have a medical camp on that day and a number of tests will be conducted here with treatment. In summary, those are the activities for that day of the Malaria Walk, but I am also inviting Members to participate in the commemoration of the World Malaria Day, come the 25 th of April this year. I thank you.

Thank you very much, honourable member for Bugiri District. Honourable minister, what the Member of Parliament is saying is that let us move away from single-carriage roads to dual ones in order to avoid the aspect of collision. And if you heard what the honourable minister said before, you notice that this accident occurred as a result of a collision. The driver of the other car just went to the side where Hon. Okabe was driving. If we have a dual carriage road, we could be able to avoid collisions of that kind. So, think about it as you come up with the next designs for roads.

We are still holding our position as the Legislature. (Applause) Nevertheless, whatever is to be done is the role of the Executive. We have given our position as the Legislature, that we are not in for whatever is happening. So, it is left to the Executive to ensure that it does not - Honourable members, on 25 August 2022, the Chief Opposition Whip, Hon. Nambeshe, directed a question to the Chairperson of the Committee on Budget, on budget allocation to the Contingency Fund pursuant to section 26(1) of the Public Finance Management Act. The Chairperson of the Committee on Budget is ready with his response and he will be presenting it. However, allow me to first amend the Order Paper that will have the Computer Misuse (Amendment) Bill, 2022 so that the Attorney-General will be able to contribute to it since he is going for another engagement. Remember, we have only one legal adviser in the country. So, we will look at that Computer Misuse (Amendment) Bill, 2022, and then continue with the rest of the business, as usual. Thank you for standing by your word. Honourable members, in the Public Gallery this afternoon, we have a delegation of Urban Council Speakers from Bugiri District. You are most welcome.
