Thank you, Mr Speaker. This is a statement to Parliament in response to issues raised on the Floor of Parliament, regarding the Contract between M/S SICPA SA and the Uganda Revenue Authority (URA) for the supply, implementation, training, commissioning, support and maintenance of a tax verification, quality and safety system. Mr Speaker and colleagues, during the Parliamentary sitting of Thursday, 4 May 2023, while considering the Tax Procedure Code (Amendment) Bill, 2023, Hon. Mohammad Muwanga Kivumbi, the Member of Parliament for Butambala County, raised the following issues regarding the contract between the Uganda Revenue Authority and M/S SICPA SA for the supply, implementation, training, commissioning, support and maintenance of a tax verification and quality, safety system; i. The actual money collected by URA is very minimal because the agreement between URA and M/S SICPA SA gives SICPA a portion of the total sum of the revenue collected for no work done; ii. SICPA is tax-exempt; and iii. SICPA was not sourced competitively. This is our resolution of the issues as framed and raised by Hon. Muwanga Kivumbi: 1. The actual money collected by URA is very minimal because the agreement between URA and SICPA gives SICPA a portion of the total sum of the revenue collected for no work done. Colleagues, on 4 October 2018, URA and SICPA signed a contract for the supply, implementation, training, commissioning, support and maintenance of a tax verification, quality and safety system, a digital tax stamps solution. The contract was cleared by my office. The consideration for the services is set out in the table below. We have itemised things like water and the amounts per unit. The purpose of the above contract is for SICPA to develop and supply a digital stamp solution to enable URA to audit Excise Duty taxpayers and track excisable goods for purposes of collecting the Excise Duty Tax. The introduction of tax stamps has its origins under Section 19(a) of the Tax Procedure Code Act 13, 2014, which states, 19(a), tax stamps: i. “A person dealing in goods whether locally manufactured or imported shall affix a stamp on any goods locally manufactured or imported as may be prescribed by the minister in subsection 3. ii. The Commissioner shall prescribe the manner in which a tax stamp is to be affixed to goods. iii. The minister shall prescribe by statutory instrument the locally manufactured or imported goods on which the stamps shall be affixed.” Regulation 3(1) of the Tax Procedure Code, Tax Stamps Regulations, Statutory Instrument No. 53 of 2018 provides that every package of prescribed goods manufactured in or imported into Uganda shall be affixed with a tax stamp. Regulation 6(3) of the same regulations, states that the manufacturer or importer shall pay for the stamp fees. Pursuant to Regulation 7(1) of the same regulations, the Commissioner-General is mandated to set the fee to be paid for the tax stamps by notice. In accordance with this mandate, the Commissioner-General issued

Thank you very much, Mr Speaker. Mr Speaker, allow me to also take this opportunity to congratulate you upon assuming that office. I also want to join my colleagues in thanking the President for his address on the 4 th of June. I want to draw your attention specifically to the first paragraph of the address, where the President thanked Ugandans and congratulated them for participating in the series of elections since the 15 th of January 2026. He also thanked them for massively supporting NRM. As you are aware, the 2026 elections were characterised by massive human rights violations as a result of the brutality from police, the army, and the unknown goons. As a result, many people died; for example, in my district, we lost about three people, and many people were injured, and they ended up admitted to hospitals. This did not only happen in Kayunga, but a case to note is Butambala District and so many other districts where people died. The public expected the President to condemn this act. The mothers who lost their children, the wives who lost their husbands, the surviving victims, expected the President to condemn these acts and also, where possible, give an apology. Mr Speaker, I want to give an example of my district. In my district, especially on tallying day, we had fabricated results, and as a result, we had very many cases right from the MP to the LCIII elections, where the people who did not win were declared winners. If you go to different Local Council III, LCV, and probably even here in Parliament, we have people who were declared winners when, in actual sense, they used fabricated results. Mr Speaker, it is our noble duty as Members of this Parliament –

A member from Ruhaama East says the district gets the same money as Butambala, even though it is five times larger, and complains that the Ministry of Finance has not increased funding. The member recalls a meeting with the President and the minister to address the issue.

Thank you, Madam Speaker. I represent Ruhaama East, which is one of the five constituencies in Ntungamo District. Madam Speaker, what you are saying is right. My constituency of Ruhaama East is the size of Butambala District. Butambala District receives Shs 1 billion and Ntungamo District, which has five constituencies – and is five times the size of Butambala – receives Shs 1 billion, too. We have been complaining over this issue and I remember that in March last year, we met the President. The President even called the Minister of Finance, Planning and Economic Development over that issue – to provide more money to the bigger districts. I was in that meeting, in Ntungamo. He even put him on a loud speaker and we all listened. I do not know why the Ministry of Finance, Planning and Economic Development is not providing this money. We have suffered. Some of us lost elections because of that issue, Madam Speaker. Thank you, Madam Speaker, for following up on this matter.

15093 THE ELEVENTH PARLIAMENT OF UGANDA WEDNESDAY, 23 OCTOBER 2024 by the Ministry of Education and Sports, failure to procure contractors under the Uganda Support to Municipal Infrastructure Development (USMID) programme and the delayed completion of projects under the Uganda Intergovernmental Fiscal Transfers (UgIFT) programme, among others; iii. The Ministry of Finance, Planning and Economic Development, in some instances, released funds to the entities over and above what was requested for by the entities. Some entities did not have information about such releases by the Ministry of Finance, Planning and Economic Development which found them ill prepared for the money hence some being swept back to the Consolidated Fund; iv. The Ministry of Finance, Planning and Economic Development, in some cases, released funds late to entities. Several entities informed the committee that funds were received at the end of the last quarter of the financial year, which made absorption of the same almost impossible. Committee recommendation The committee recommends that: i. The Ministry of Finance, Planning and Economic Development should explain why funds were not released to the local governments as budgeted and in a timely manner as well as those released over and above requests made by the entities. ii. Accounting officers under the supervision of local governments who failed to utilise funds released to them without justifiable reasons should be held personally liable. iii. Relevant entities should streamline their budget performance and ensure timely recruitment and placement, procurement timelines and follow-up on timely releases in order to improve funds absorption. iv. Accounting officers should follow up with the Ministry of Finance, Planning and Economic Development on the budget shortfalls affecting service delivery. 2. Local Revenue Performance The 56 local government entities had an approved local revenue budget of Shs 121.39 billion, out of which Shs 86.4 billion was allocated and released back to the local government, hence, a revenue collection of 71 per cent of the approved budget. A sum of Shs 34.98 billion remains uncollected at the end of the financial year. The warrant releases are based on what the local governments collect and is deposited with the Consolidated Fund as per the requirements of Section 29(2) of the Public Finance Management Act, 2015. The under-collection undermines service delivery as councils greatly rely on local revenue for support, supervision and facilitation of the council’s settings. Thus, improvement in its administration is required to improve service delivery. A number of local governments under review posted good performance, led by Butambala District Local Government at 278 per cent, Koboko Municipal Council at 232 per cent, Yumbe District Local Government at 131 per cent, and Koboko District Local Government at 128 per cent, while the lowest performance was registered by Lira District Local Government that realised only 11 per cent of its approved local revenue budget, Apac Municipal Council at only 23 per cent, Adjumani District Local Government at 35 per cent, and Pakwach District Local Government at 48 per cent, as per the budget performance annex 1. The accounting officers, with a good revenue performance, informed the committee that they had been enrolled on the Integrated Revenue Administration System (IRAS), which has enhanced revenue collection. Madam Speaker, additionally, accounting officers informed the committee that they had developed revenue enhancement plans, and

15094 THE NATIONAL COFFEE (AMENDMENT) BILL, 2024 they were optimistic that this would improve their revenue collection. For example, districts such as Wakiso District Local Government and Pakwach District Local Government reported and submitted to the committee their revenue enhancement plan. Committee observation The committee observed that: i. Under-collection undermines service delivery, as councils greatly rely on local revenue for support, supervision and council sittings. ii. Under-collection of local revenue denies the entities resources for implementation of the planned activities. iii. Some entities did not have robust revenue collection mechanisms, which explains the low local revenue collections. iv. The entities that performed well set revenue targets that were below their revenue potentials, and this explains the over-performance. Committee recommendations The committee recommends that: i. The accounting officers should strengthen local revenue collection efforts to ensure the availability of adequate funds for service delivery, for instance, by conducting in-land benchmarks with the best performing local governments. ii. The accounting officers should conduct revenue enumerations and assessment exercises to inform revenue planning and enforcement. iii. The accounting officers should put in place revenue enhancement plans to increase local revenue to match the entity’s revenue potential. iv. Owing to the positive feedback regarding IRAS, the Government should consider rolling out the system to all entities that have not started using the system. v. Accounting officers should strengthen capacity building for parish chiefs and town clerks, charged with the duty of revenue collections. Madam Speaker, we are looking at the performance of government warrants. The Auditor-General noted that most entities received less than what they budgeted for, thereby affecting service delivery. For instance, Lira City budgeted to receive Shs 68,046,036,451, out of which Shs 47,554,468,848 was warranted, resulting in a shortfall of Shs 20,491,840,032 representing 70 per cent performance. Nebbi District Local Government budgeted to receive Shs 46,692,271,928 out of which Shs 41,427,847,639 was warranted, resulting in a shortfall of Shs 5.264 billion, representing 89 per cent performance. Buikwe District Local Government budgeted to receive Shs 53.915 billion, out of which Shs 35.836 billion was warranted, resulting in a shortfall of Shs 18,793,000,000, representing 66 per cent performance. The auditor, however, noted that the realisation of budget funds to finance work plans is always impacted by the limited resource envelope resulting from the persistent budget cuts. The accounting officers explained that they had no control over warrants and cash limits but continuously engaged the Ministry of Finance, Planning and Economic Development to provide funds for the affected activities. Additionally, the accounting officers from some entities informed the committee that they received funds over and above what they had requested, for which they could not absorb. For instance, the accounting officer of Butambala District Local Government [Mr Olanya] STANDING COMMITTEE REPORT

15095 THE ELEVENTH PARLIAMENT OF UGANDA WEDNESDAY, 23 OCTOBER 2024 informed the committee that whereas the entity requested Shs 1,122,022,625 for wages, Shs 5,560,783,170 was released to the district, as per the auditor’s analysis, hence resulting in some funds not being absorbed. Similarly, Kitgum District Local Government received a supplementary funding of Shs 2,855,427,080 which was not requested by the accounting officer and out of it, Shs 1,914,099,546 was not utilised by the entity. Committee observation Madam Speaker, the committee observed that: i. Most local governments were unable to carry out the planned activities because they did not get all the funds from the approved budget. ii. The Ministry of Finance, Planning and Economic Development, in some instances, released funds to entities over and above what was requested by the entities. iii. The Ministry of Finance, Planning and Economic Development, in some cases, released funds late to entities. Several entities informed the committee that funds were received at the end of the last quarter of the financial year, which made absorption of the same impossible. Committee recommendation The committee recommended, Madam Speaker: i. An investigation should be carried out on why the Ministry of Finance, Planning and Economic Development releases funds over and above what has been requested by the entities. ii. Accounting officers should follow up with the Ministry of Finance, Planning and Economic Development on the shortfalls affecting service delivery. Madam Speaker, we looked at the utilisation of warrants. The Auditor-General noted that there was under-utilisation of warrants, which affected performance as planned activities were either partially implemented or not implemented at all. The accounting officers explained that much of the unobserved funds were meant for planned recruitment, which did not materialise due to a ban on recruitment. That was issued by the Government, while others did not have functional district service commissions, for instance, Mukono District Local Government. They also explained that there was also a delayed procurement process due to the hybrid procurement process, which the entities had no control over, as it was handled by the Ministry of Agriculture, Animal Industry and Fisheries (MAAIF). MAAIF delayed to provide the pre- qualified list of service providers. The accounting officers also attributed the underutilisation of funds to the delayed release of funds by the Ministry of Finance, Planning and Economic Development (MoFPED), as most funds were released in the last month of the financial year. Accounting officers from some entities informed the committee that they received funds over and above what they had requested, which they could not absorb. For instance, the Accounting Officer of Butambala District Local Government, as I read earlier, and all those. Committee observations Madam Speaker, the committee observed that: i. Whereas the Ministry of Finance did not release all the funds budgeted for, most entities did not utilise the warrants, which greatly affected the implementation of plan activities. ii. The unspent balances were attributed to a number of factors, including failure to recruit due to the ban on recruitment,

Thank you, Mr Speaker. Butambala District is one of the poorest districts in Buganda. Unfortunately, we have not benefited from the four-acre plan that was initiated by the Government because the majority of the people do not actually have the four acres. The proximity of us to the city makes us have very small pieces of land. We have not even benefited from the one-acre plan I have heard. We are known for two products; “mairungi” which was recently outlawed and ginger which is only grown in one parish. Unfortunately, there is no effort to add value to this ginger. We cannot eat it. It is only the Kenyans who come and buy from us whenever they want. So, many times, the market fluctuates as to the interest of Kenyans. Fortunately, we have a maize mill that was given by the Government to one of the parishes called Kyerima. We are also disadvantaged in the way that that maize mill was not given power. It has been lying there idle for many years. I will be able to submit to you. We have also not benefited from the African Development Bank (ADB) programme because my people cannot afford the 25 per cent. It is there on books, but not many people actually have benefited from that programme because when we tell people to cost-share, they do not have anything to give. My humble prayer to the honourable minister is: can we help the people of Butambala? This is because we are too poor to benefit from the four-acre model. The one acre-plan has not come to us, the ADB has not helped us and no value-addition programme has benefited us as of yet.

7879 THE ELEVENTH PARLIAMENT OF UGANDA WEDNESDAY, 5 APRIL 2023 Ethics and Integrity. Therefore, we recommend approval of Shs 401.68 billion for those various Votes. Shs 1.627 billion as reallocation within the local government budgets. The table is as below: i) Butambala District – Shs 1.5 billion ii) Ssembabule District – Shs 127,469,171 The committee was informed that Shs 127 million was appropriated for Vote 926: Ssembabule District, for the Financial Year 2022/2023 to support health centres in the district. However, the accounting officer requested that the above funds be reallocated for the purpose of procuring land for a health centre IV. The Ministry of Health informed the committee that the said land was donated to the district by an individual. In light of the above, the committee declines the approval of reallocation of Shs 127 million for Vote 926: Ssembabule District Local Government, to procure land and recommends that this fund should be retained for its original purpose. The committee recommends approval of Shs 1.5 billion to Butambala Local Government. Part B This is a supplementary request that requires prior parliamentary approval. Government is requesting for Shs 1.538 trillion under Schedule No.1 with the addenda. This is above the 3 per cent legal limit for both development and recurrent expenditure. The Votes are as follows: i) Vote 004: Ministry of Defence and Veterans Affairs – Shs 339.809 billion required to cover the shortfall on wage. This will be funded by a corresponding suppression in the classified equipment project. We recommend approval of Shs 12.979 billion. iii) Vote 011: Ministry of Local Government, Shs 13.978 billion is required as follows: a) Shs 13.179 billion as external financing from the African Development Bank for Markets and Agricultural Trade Improvement Project (MATIP 2). Thank you very much, Madam Speaker, for the opportunity and advice. Indeed, the committee has been able to conclusively handle all the entities as reported by the Auditor-General. We will be able to provide all the other reports by next week. I take your advice. Before I present this report, permit me to lay on the Table minutes of the committee meetings and a copy of the report. Madam Speaker, just as you guided - and for purposes of saving time - on the 24 th of August this year, I presented a report of the committee, covering 14 entities. Today, permit me to present this report, which covers the audit queries contained in the report of the Auditor- General for the financial year ended 30 June 2021 for the following local governments; Apac District Local Government, Nansana Municipal Council, Makindye-Ssabagabo Municipal Council, Kira Municipal Council, Mityana District Local Government and Butambala District Local Government. To save time, from page one – this gives the introductory part and background to the report I am going to present. I request that you allow me not to spend a lot of time here and instead move to cross-cutting issues. On page 8, where we have general and cross- cutting audit queries, I refer honourable colleagues to the previous report that I gave – as I stated – on the 24 th of August, where we gave details of those cross-cutting audit queries and issues covering those entities. It would be a repetition if I run through the cross-cutting issues. If that permission is granted, Madam Speaker, I now request that you allow me to go to the specific local government entities. I request Members to go to page 28.
