12568 SECTORAL COMMITTEE REPORTS The Petroleum Authority of Uganda also wants to do a real-time monitoring centre so that they know the amount of oil being pumped at any one time. The committee recommends that Government allocates additional Shs 50.7 billion to enable the Petroleum Authority of Uganda to develop the real time monitoring centre. On the disaster recovery solution, the committee recommends that the Government allocates an additional Shs 8.15 billion to enable power to develop the disaster recovery solution. Mr Speaker, those are the recommendations on the Ministry of Energy and Mineral Development. I now move to the Ministry of Water and Environment. Allow me also to premise my presentation by saying that water is life. There is a lot of contamination of the waters that we drink. If you go to developed countries, you find that you can drink water directly from a tap. We cannot do that here in Uganda. Our focus was drawn to the contamination going on in Lake Victoria and the need to establish a quality laboratory to assess whether we are drinking arsenic, lithium, or whatever chemicals that are entering Lake Victoria, which will have adverse health effects in our lives in the near future. The observations under this sector include: Mainstreaming climate change and implementation of the Climate Change Act, 2021. We recommend that the Government provides Shs 10.9 billion to the climate change department under the ministry to enable implementation of the Climate Change Act. On carbon trading mechanisms, our recommendations are that: (i) Government should implement a centralised platform for collecting and storing emissions data from regulated entities, ensuring accuracy, transparency, and accessibility of information. (ii) Government should provide training, technical assistance, and capacity-building programmes to empower regulators, market operators, and market participants with the skills and knowledge needed to navigate carbon markets effectively. (iii) Government should develop electronic trading platforms and market infrastructure to facilitate the buying, selling and trading of carbon credits. (iv) Government should allocate resources towards development of the carbon trading policy and regulations. The next is the need to support rural water project-source per village as directed by His Excellency the President. Our recommendation agrees with him that Government should provide Shs 50 billion to support improvement of water storage and network expansion countrywide. Strategic towns, water supply and sanitation project Key towns where this project is being implemented include Kamuli Municipality, Kyenjojo - Katooke, Buikwe, Dokolo, Kyenjojo Town Council and Katooke Town Council. Our recommendation is that Governments should provide Shs 12 billion as counterpart financing. Mr Speaker, you talked about this earlier on required for this project. Failure to provide this funding will result into penalties on the side of Government. Inadequate budgetary allocation to Service Coverage Acceleration Project (SCAP 100- Umbrellas)

The government has secured $66 million from the African Development Fund for the Strategic Towns Water Supply and Sanitation Project, but needs an extra UGX 12 billion to meet counterpart funding. Without it, delays will raise costs and hurt towns like Kamuli, Kyenjojo, Buikwe and Dokolo.

The funds will be used to improve water storage and network expansion countrywide. This will make the network more economically viable and serve more people from the available sources. It will also increase the number of sources per village under the rural water component. Recommendation: . Government should provide UGX. 5O billion to support improvement of water storage and network expansion countr5mide. (df Strategic Towns lllater Supply and Sanitation Project (STWSSPI The Committee observed that Government secured donor financing amounting to USD 66 million from the African Development Fund for the implementation of Strategic Towns Water Supply and Sanitation Project with Government to provide counterpart funding. However, project implementation continues to be affected due to lack of counterpart funding. This will escalate the cost of the project implementation due to penalties arising from delayed payment of contractors. The Committee was informed that the Ministry requires additional funding of UGX. 12 billion to meet the counterpart funding obligations to increase the network coverage in the towns under implementation which include the following; Kamuli Municipality, Kyenjojo-Katooke, Buikwe, Dokolo, Kyenjojo town council and Katooke Town Council. \ -l I , rx \ Y Y .r. h d' 32

The committee says local governments should keep and spend their own revenue, not send it to the national fund. It also says markets built under MATIP are not working well, especially in Busia Municipality, and more markets are needed in Kaliro, Kamuli, Adjumani and Gulu.

12424 MOTION FOR A RESOLUTION Government should instead focus on addressing the challenges associated with spending local revenues at source by, for example, enforcing its policy reform to address capacity gaps, incompetence and corruption in local government. The committee also takes note of the fact that Parliament has time and again expressed the need to review the seemingly contradictory legal frameworks, but Ministry of Finance has not taken concrete steps to reverse the status quo. Committee recommendations 1. Ministry of Finance, Planning and Economic Development should withdraw the directive to local governments to remit local revenues collected by the local governments to the Consolidated Fund in line with Section 29(1) and (3) of the Public Finance Management Act. And local governments be allowed to collect, manage and spend the local revenues from a general fund account maintained at the district level in accordance with Section 80 to 82 of the Local Governments Act and other relevant laws. 2. The Ministry of Finance, Planning and Economic Development and Ministry of Local Government expedites the process of addressing the shortcomings associated with the collection and management of local revenues at source by local governments before and at the end of the calendar year 2024. This is to aid the local governments in handling their local revenues. Under Markets and Agriculture Trade Improvements Programme (MATIP) 3 Committee observations i. All the markets built under Markets and Agriculture Trade Improvements Programme MATIP 1 and 2 are complete and functional. ii. There has been significant economic improvement and household income in the areas where the MATIP markets have been constructed. iii. There are design challenges and gaps in the completed MATIP markets that are posing serious challenges to the vendors in those markets. iv. Functionality and utilisation in some markets remain poor, for example, in Busia Municipality, where the market is functioning at about 30 per cent. v. Some cities are highly populated, hence overcrowding in the constructed markets. vi. The MATIP markets are concentrated majorly in cities and municipalities, leaving out town councils that are highly populated and require such facilities. Recommendations 1. Funds be availed for the additional eight markets under MATIP 3. 2. In addition to the eight markets, Ministry of Local Government should include Kaliro Town Council, Kamuli Municipality, Adjumani Town Council and an additional market for Gulu City. 3. Ministry of Local Government should carry out a detailed technical assessment of the constructed markets with a view of correcting the defects and design errors therein. 4. Ministry of Local Government should use the existing markets and the challenges observed in their operationalisation to inform the design for the plan of MATIP 3 markets. 5. Ministry of Local Government should pay attention during the design phase and all the consultants accountable for any design flaws. Remuneration of leaders Madam Speaker, the committee observed that local service delivery and overall development across the country is greatly dependent on motivated and well-facilitated political leaders who carry out monitoring, oversight, legislation and executive functions in local governments. 11098 MINISTERIAL STATEMENT The Kampala-Jinja section will include eight lanes for the first three kilometres and six lanes for the next 17 kilometres and four lanes for the remaining 54 kilometres. The Kampala Southern Bypass will have four lanes for 20 kilometres connecting the Northern Bypass at Namboole National Stadium to Entebbe Expressway Spur at Munyonyo. The Kampala-Jinja Expressway Project is to be undertaken as a Public Private Partnership (PPP)in accordance with the PPP Act, 2015. The private partner will finance, design, construct, operate and maintain the road for 30 years. The procurement process for the right private sector partner is ongoing and is expected to be completed by the end of this financial year. Once the procurement is done, the works will commence after the developer has secured the private capital required for the construction works. The construction period is planned to take five years. In preparation for the construction works, the Government of Uganda is currently acquiring the land for the project. So far, the land required for 44 kilometres has been acquired. This includes 14 kilometres along the Southern Bypass and 30 kilometres along the Kampala- Jinja main line. The progress of the compensation has been slowed down by some challenges, for example, lack of ownership documents and contestation of ownership. By December 2024, the Government targets to have acquired the full section from Kampala to Namagunga and the whole Kampala Southern Bypass. The rest of the land from Namagunga to Jinja is planned to be acquired by December 2025. In the meantime, the Government will continue to maintain the existing Kampala-Jinja Road in a motorable condition and to ensure the smooth flow of traffic along that route. I would like to assure you and the public that the Government of Uganda is committed to ensuring that the Kampala-Jinja Expressway Project is implemented to improve efficiency of Uganda’s transport infrastructure. Hon. Henry-Maurice Kibalya, Member of Parliament, Bugabula County South. He raised a matter concerning a group of people that migrated and settled in Namwenda Subcounty dealing in moneylending business and harassing members of the community. His prayer is that: Can the Prime Minister inform him whether the Government is aware of these moneylenders in Kamuli? Madam Speaker, Kamuli is one of the districts in Busoga Subregion. It has 14 subcounties and four counties. Some of the subcounties are Namwendwa, Nawanyango, Kisozi, Bulawoli, Kisambira and Mbulamuti. The four constituencies are Bugabula North, Bugabula South, Buzaaya and Kamuli Municipality. The total population is approximately 446,000 people. The main economic activity is farming and the main crops grown are sugarcane and rice. The people need money to boost their farming activities, thus they need to get loans from moneylenders. Madam Speaker, there are 32 registered moneylenders in Kamuli District. They demand for the borrower’s national ID as part of security for the loan. Other lenders demand for household items such as chairs, fridges, etc. In case of defaulting in making payments, they grab the properties and, in some instances, illegally detain them. I have attached a list of moneylenders in Kamuli District. Madam Speaker, the district security committee embarked on a mass sensitisation to the locals to desist from using national IDs as collateral to reinforce the guidance recently given by the [Ms Nabbanja] PRIME MINISTER’S TIME

Thank you, Mr Speaker. On the 5 th of this month, there was a heavy downpour. The rainstorm was heavy in the area of Naibowa, a parish in Butansi Subcounty in Kamuli District. More than 50 homesteads, gardens, and people’s animals were destroyed. There is a lady who is near there, who is a traditional healer, who took advantage of those families that got affected; those with wounds, and broken limbs because of the downpour, so she is hosting and treating them because the number was too big to be accommodated in Kamuli Hospital. There is a lot that is going on there, Mr Speaker. The families in the small villages of Bulyampanda, Butimbo, and Buluke in that parish are really struggling and suffering. My prayer is that the Office of the Prime Minister could come to the rescue of these people and help them with some food. At the same time, most of these structures that were destroyed require some iron sheets and some help. The Office of the Prime Minister and the Minister of Disaster Preparedness could come to the rescue of these people and help them.

“For instance, in this House last year, Hon. Henry Kibalya, the MP for Bugabula South in Kamuli District, submitted to this House a report on the dubious acts of money lenders in his constituency.”

13058 SECTORAL COMMITTEE REPORTS Regulatory function Madam Speaker, you are alive to the fact that a number of Members have submitted to this House matters of national importance concerning money lenders, who storm lower local governments and defraud our people, including taking their national IDs. For instance, in this House last year, Hon. Henry Kibalya, the MP for Bugabula South in Kamuli District, submitted to this House a report on the dubious acts of money lenders in his constituency. While these issues have been raised in the House, the supposed regulator went silent as the loot continued. Additionally, while UMRA was also intended to support SACCOs, the Ugandan SACCOs have been on their own. If it was not for the work of commercial officers in local governments, the SACCOs would have fallen into the temptation of defrauding Ugandans as well. There is no sign that UMRA, in its current state, will rise up to the task and be effective and efficient. For instance, one does not need money to issue a statement to the public and, so, the excuse of limited funding as a justification for inaction cannot suffice. (Applause) Lending rates While Section 90 of the Tier 4 Microfinance Institutions and Money Lenders Act, 2016 stipulates that the minister (with guidance by UMRA) shall set the guidelines for lending rates, UMRA has continuously advised to the contrary and has, therefore, made it impossible for lending rates to be regulated. As a result, some lenders charge up to 30 per cent per month. This is 360 per cent per annum, the highest in the world. The exploitation must stop, Madam Speaker. The majority opinion recognised this anomaly, but was shy to give a befitting recommendation. Administrative processes of rationalisation Madam Speaker, the majority opinion has pitched justification on the cost and process of administering rationalisation, rather than the efficiency in the outputs expected of a regulator. Therefore, in our opinion, this Parliament should not be burdened by the administrative processes of rationalisation, for example, settlement of staff, obligation and the cost of deployment, as this is a role the Executive can execute effectively. To assume that the Ministry of Finance, Planning, and Economic Development cannot handle these administrative processes is to undermine the basic capacity of any Government ministry in Uganda. Rationalisation of a supposed regulator While it might look unthinkable to rationalise a regulator, however, over the years and prior to 2016, all ministries that had a regulatory function did have departments in charge of regulation. For instance, the Ministry of Energy and Mineral Development has continued to effectively regulate the mining sector, a sector more highly rated in terms of net value than even the micro lending sector. This is evidence that a Government ministry can carry out this function with ease, without the excessive expenditure. Recommendations 1. UMRA be mainstreamed into the Ministry of Finance, Planning and Economic Development. 2. Section 90 of the principal Act be amended by replacing “the Minister regulating the maximum interest rate” with “The interest rate to be charged by a moneylender shall not exceed eight per cent per month, equivalent to 96 per cent per annum as a maximum” – because it has been clearly demonstrated that this sector cannot be regulated by anyone. So, the law must be put to use. Conclusion Madam Speaker, the rationalisation plan is meant to improve efficiency, eliminate duplication and enhance cost-saving on the Government. The opportunity has come for us, not only to achieve these rationalisation objectives, but also to sanitise the micro- THE TIER 4 MICRO-FINANCE INSTITUTIONS AND MONEY LENDERS (AMENDMENT) BILL, 2024 [Ms Nakut]

Thank you, Mr Speaker. I have two issues. Firstly, last week on Wednesday, a heavy downpour destroyed many houses in Butende. Many families are homeless now and crops were destroyed. Mr Speaker, we need the Prime Minister to come to the rescue of these families in Butende Parish, Kamuli District. Secondly, on the night of Easter Sunday, a group of young men came and invaded Namwendwa Town Council. They injured 11 youths who were returning from watching a football match. Up to now, they are in hospital nursing injuries. The gang had machetes, pangas and others. The village is now in disarray. Rt Hon. Prime Minister, we need your intervention.

I thank the honourable minister for the statement. In the Financial Year 2020/2023 budget, there was money – (Break in recording.) As Kamuli District, we received Shs 6 billion. However, because there was a mandatory contribution of 25 per cent, half of the money came back to the Centre. Our appeal is that the 25 per cent is high. We should reduce it because irrigating our crops is very important, yet our people cannot afford it. Secondly, honourable minister, as you talk about water, in most of our schools, the population is high and they share boreholes with the communities. This is becoming a bit of a problem. We could put tanks in these schools, harvest water and save a lot of money and time. This would also solve the burden of students going out of the school premises to fetch water. I thank you, Mr Speaker.
