A member said that service delivery should match administrative units, like giving each district a road unit. He used Ruhaama as an example, urging that each area get its own road unit to improve service delivery.

Thank you. Hon. Stephen Kagwera, what you are saying is in line with what hon. Byanyima said. The problem is simple. Service delivery is based on units of administration; every district, a hospital; every sub-county, a secondary school and every parish, a primary school. In the end, people clamour for services because the channel provided. You have a district like Ntungamo or if you divide a county like Ruhaama - When you go to a big district like Ntungamo and you are using the same criteria of the road unit for a district of one constituency, what will people of Ntungamo do? They will clamour saying, divide and give us four districts so that we can have four road units. Therefore, after this budgeting process, maybe we should have an honest discussion in relation to service delivery – (Applause) - how do we allocate service delivery? This will even make it easier for the Executive and everyone. We have data, we have done a census. We can say that for every population or geographical area of this magnitude, let us have a road unit. I think that will be the only solution and it is high time we put our heads together and discussed it openly or else, service delivery in this country will remain down.

A member asked why Law Development Centre only admits applicants with a CGPA of 3.6 or higher, leaving many denied without remedy. The speaker explained that admission depends on LLB performance and that those not admitted may be deferred to the next year.

14734 STANDING COMMITTEE REPORT horticultural crops such as cabbages, water melon and carrots. Communities in Agu were also provided with the following alternative livelihood benefits as listed below. 1. An automatic weather station was established which provides farmers with early warning information, that is impacting their productivity and strengthening resilience to climate change impact. Question number 5 came from Hon. Nkwasiibwe Zinkuratire Henry (MP Ruhaama County. That on 20 August 2024, Law Development Centre released notifications to applicants who have been admitted for the academic year 2024/2025. Majority of the applicants were however denied admissions without any remedy whatsoever. He personally made inquiries with the Director, LDC’s office and was informed that they only admitted applicants that had a CGPA of 3.6 and above from their respective Universities. Furthermore, that there has been no remedy provided to those applicants that have not been admitted despite LDC having issued no notices for the said mark at university in order to apply and join. It should be noted that it is only LDC with the monopoly to teach the Post Graduate Diploma in Legal Practice and nobody can practice law in this country without this diploma. His prayer is that what is the legally required mark for one to join Law Development Centre for a Post Graduate Diploma in Legal Practice? My response, Madam Speaker, is a bit lengthy and I request you to be patient. The entry requirement for a Postgraduate Diploma in Legal Practice at Law Development Centre is proof of completion of a Bachelor of Laws degree from an accredited university in Uganda. This applies to applicants that have studied LLB from Uganda. Depending on the number of applicants vis- a-vis the institutional capacity, management admits applicants based on their LLB academic performance. This was emphasized in an official communication published on 22 August 2024. Previously all those who were not admitted in an academic year of their application would automatically qualify for deferred admission to perhaps the next academic year. His prayer number 2 was, what is the fate of those who have not scored the said Cumulative Grade Point Average (CGPA) of 3.6 at the university level? Does that mean they are automatically denied a right to practice law since the Law Development Centre (LDC) has the monopoly to teach the Postgraduate Diploma in Legal Practice? Madam Speaker, this is my response. Law Development Centre admitted a total of 1,500 students to study the Bar Course in academic year 2024/2025. This communication was published in a statement on admissions to the Postgraduate Diploma in Legal Practice programme for academic year 2024/2025, on 20 August 2024. The statement further clarified that out of the above 1,500 students, only 1,260 students are new or fresh students, who have never attended legal practice training. This means that the 240 students are repeating the course. Out of the 1,260 students, 597 had earlier on been given offer letters in the last academic year (2023/2024), to join the legal practice training in this academic year, 2024/2025, without the need to reapply. The Law Development Centre (LDC) management had no option other than respecting its earlier commitment. This implies that only 663 students were admitted from the fresh applicants of the academic year 2024/2025. Madam Speaker, the use of a Cumulative Grade Point Average was purposely to admit a number of students within LDC capacity, [Ms Nabbanja] PRIME MINISTER’S TIME

It is a bit related. (Laughter) It is also a matter of national importance. Mr Speaker, several subcounties in Ruhaama constituency were hit by strong hailstorms which massively destroyed crops and homesteads. The affected subcounties include Ntungamo, Nyarutuntu, Ruhaama and Ruhaama East. Those hailstorms have left many people homeless and they have nothing to feed on. They are living in desperation. I, therefore, pray for urgent intervention from the Government to provide relief items and food to the affected people.
Nothing here for the year you chose.

Thank you, Madam Speaker. I represent Ruhaama East, which is one of the five constituencies in Ntungamo District. Madam Speaker, what you are saying is right. My constituency of Ruhaama East is the size of Butambala District. Butambala District receives Shs 1 billion and Ntungamo District, which has five constituencies – and is five times the size of Butambala – receives Shs 1 billion, too. We have been complaining over this issue and I remember that in March last year, we met the President. The President even called the Minister of Finance, Planning and Economic Development over that issue – to provide more money to the bigger districts. I was in that meeting, in Ntungamo. He even put him on a loud speaker and we all listened. I do not know why the Ministry of Finance, Planning and Economic Development is not providing this money. We have suffered. Some of us lost elections because of that issue, Madam Speaker. Thank you, Madam Speaker, for following up on this matter.

17727 THE ELEVENTH PARLIAMENT OF UGANDA THURSDAY, 7 AUGUST 2025 in Ntungamo District, had been fully upgraded to health centres III by the time the committee did the oversight. Works to upgrade 41 health centres II were ongoing, with the majority of the projects making less than 50 per cent progress. The details are attached in Annex II. Upgrade of the remaining 81 health centres II had not started. The committee established that out of the 62 health centres III earmarked for new construction under the UgIFT II programme, only three: Kasangati Health Centre III, Kakindo Health Centre III in Kakumiro District, and Kikooma Health Centre III in Kyankwanzi District had been completed. Construction of 28 health centres III was still ongoing, while works for 31 health centres III had not yet started. See details in Annex III. The committee further established that the progress on implementation of various construction projects of new health centres III and upgrade of health centres II to III was largely characterised by defective works, prolonged delays in completion by contractors, including the UPDF Brigade, due to lack of supervision by local government leadership. All project- related decisions, including contract award and the procurement of equipment, were managed by the Central Government. Non-compliance with the standard project design The committee discovered that essential documentation regarding contracts and BOQs was absent, and the Ministry of Finance, Planning, and Economic Development delayed releasing funds, all of which affected the effective execution of the projects. There were double payments to some of the contractors by the Ministry of Health arising from a change of policy to award contracts, particularly to the UPDF Engineering Brigade. A case in point is Shs 400 million for the completion of the Ober Health Centre IV in Lira City maternity ward and theatre that was channelled directly to the Ministry of Defence by the Ministry of Health, well aware of another running contract with BP Enterprises and Construction Company Limited. See the letter attached in Annex IV. Other specific examples of such construction and upgrade projects include Kachuru Health Centre III in Butebo District, Rushare Health Centre III and Ruhare Health Centre III in Mbarara District, Kichwamba Health Centre II in Mbarara City, Kyabakuza Health Centre II in Masaka City, and Kabbo Health Centre II and Gayaza Health Centre II Mubende District. The committee observed that whereas Parliament approved Shs 552.6 billion to address infrastructure gaps in local government countrywide, a significant number of subcounties and town councils across the country still do not have health centres III. No work had been done on 81 out of 124 health centres II earmarked for upgrade to health centre III. Similarly, 31 out of 62 planned new construction of health centres III in subcounties without any Government health centres III had not even started. The committee observed that the upgraded health centres II and the newly constructed health centres III were not fully functional, largely due to inadequate staffing. There was adverse mismanagement of contracts by the Ministry of Health that involved re- awarding of already running contracts to the Uganda People’s Defence Forces (UPDF) Engineering Brigade in total violation of the Public Procurement and Disposal of Public Assets (PPDA) Act. There was a likelihood of fraud in the management and implementation of various Uganda Intergovernmental Fiscal Transfers Program (UgIFT) projects across the country. The Government had not yet fulfilled its pledge of establishing health centres III in every sub- country across the country.

16114 STANDING COMMITTEE REPORT The Office of the Leader of the Opposition organised an oversight visit to Inspire Africa Coffee Factory in Ntungamo District. I undertook this oversight visit on 11 December 2024, together with the shadow ministers. The visit was in line with Section 6E (1) of the Administration of Parliament (Amendment) Act, 2005, which empowers the Leader of the Opposition to play the oversight role and keep the Government in check. During the Financial Year 2023/2024, the Government undertook to establish a tertiary hub for last-mile coffee value addition in Ntungamo District through the Science, Technology, and Innovation Secretariat in the Office of the President under a private partnership arrangement with the Coffee Investment Consortium Uganda and Inspire Africa Coffee, both privately registered entities. The construction of this coffee value addition facility began in October 2023 and had been projected to be completed by December 2024. We were told that the factory is expected to produce various coffee products including instant coffee, drip coffee, malt coffee, coffee energy drinks, as well as beauty cosmetics. However, since this strategic Government intervention was initiated, various stakeholders, as well as policymakers have expressed concerns with respect to the implementation arrangements. Some of these concerns include: (i) Rationale followed to establish this coffee value addition factory in Ntungamo; (ii) The selection criteria followed to procure the private investor; (iii) The reason behind the decision by the Government to support the building of a coffee factory in Ntungamo District, while not paying attention to other areas known to produce a lot of coffee in Uganda; (iv) Capital investment - the exact amount of money that the government of Uganda is injecting into this project, because that is not known yet. (v) Projected economic benefits in terms of the anticipated employment opportunities as well as export revenues. Therefore, the primary objective of this oversight visit was to further interrogate and verify all matters related to the above- mentioned concerns as elaborated briefly before. During the Financial Year 2023, the Government earmarked and allocated Shs 37 billion, which is about US$ 10 million in the national Budget to support coffee value chain development under a newly created Vote 167 in the Science, Technology and Innovation Secretariat in the Office of the President. Also, according to the annual budget estimates of the Financial Year 2024/2025, an additional Shs 75 billion was provided for in the corrigenda to the budget and approved by Parliament to support coffee value addition initiatives. To date, a total of Shs 112 billion has been appropriated by Parliament towards support for coffee value-addition initiatives. Some of these initiatives include the promotion of Uganda coffee globally through coffee trade hubs and the establishment of a tertiary hub for last mile coffee value addition in Ntungamo District, implemented by Inspire Africa Coffee, which according to Mr Nelson Tugume, the proprietor, is at an estimated cost of US$ 122 million, that is about Shs 451 billion. It is important to note that these coffee value addition initiatives are not directly implemented by the Government, but rather through partnerships, such as the Presidential Advisory Committee on Exports and Industrial Development that is chaired by Mr Odrek Rwabwogo, the Senior Presidential Advisor on Special Duties. 16115 THE ELEVENTH PARLIAMENT OF UGANDA TUESDAY, 11 FEBRUARY 2025 There is also the Coffee Investment Consortium, a privately registered entity comprising about 21 coffee companies interested in promoting coffee production and providing value addition in the coffee value chain, and Inspire Africa Coffee, an affiliate of Inspire Africa Group, a human resource organisation initially established primarily to address the challenges of youth unemployment on the African continent. Government argues that the initiatives will significantly increase the country’s coffee export earnings through the export promotion of processed, ready-to-drink coffee instead of raw coffee beans. However, since the above- highlighted coffee value addition initiatives were earmarked and subsequently funded by the Government, various stakeholders as well as policymakers have expressed serious accountability, legal, and policy concerns with regard to the implementation arrangement of these initiatives. Therefore, it was paramount to further interrogate and verify all matters related to the implementation of these initiatives, to ascertain their feasibility and value for public funds in line with the existing legal and policy frameworks. Let me run through the areas of concern, Madam Speaker. (1) Funding and transparency queries In the financial year 2023/2024, the Government of Uganda allocated resources through the Science, Technology, and Innovation Secretariat under the Office of the President towards the establishment of a modern industrial coffee park in Rwashamire Town Council in Ntungamo District. We found that there is no memorandum of understanding between the Government of Uganda and this private entity. So, the manner in which money was extended to this entity is not clear. Madam Speaker, it is wrong for taxpayers’ money to be spent without any clearly defined binding relationship between the Government and any entity, and in this case, Inspire Africa Coffee, and no documentation whatsoever. The proprietor told us that there was a co- investment arrangement that was ongoing between the parties, that is the Government and them, but there was no clarity on whether this arrangement would result in a joint shareholding, a grant arrangement, or a bailout. We recommend, together with my colleagues, as follows: (i) The Government should come out clearly on the relationship that exists between Inspire Africa Coffee and the Government that warranted the disbursement of public funds to this private entity. (ii) Parliament should stop any further disbursements to this entity until a clear and rational memorandum of understanding is reached between the Government and this entity. (iii) The Government ought to come out with a clear procedure on how private entities can get Government support. Uganda has many young and innovative entrepreneurs who only lack funding. If the Government comes out clearly on the formalities, then more Ugandans could benefit as opposed to just a few. (2) Unfulfilled Government commitments. Uganda is currently the leading coffee exporter in Africa and the second largest coffee producer in Africa having exported 6.13 million bags in Financial Year 2023/2024, valued at over US$ 1.14 billion. In order to handle the value additional call, the Government stipulated under the National Development Plan NDP III that two modern industrial coffee factories would be established, one in Bugisu and another one in Buganda, because these are the highest coffee-growing regions in the country. These two factories were to be constructed by the end of June

It has been about nine months since the Government put an animal quarantine because of Foot and Mouth Dis - ease, specifically in my constituency which is in Ntungamo district. So, the whole of Ntun - gamo District is under quarantine. I thank the Government for giving vaccines and they have vaccinated all the animals. I walked all over my constituency because people actually depend on animals. There is no Foot and Mouth Disease but the markets have been completely closed. People cannot sell their animals, yet they have to pay school fees. They literally depend on animals. May I know why these markets cannot be opened, yet people have vaccinated their animals? Secondly, Madam Speaker, we have been hit very badly by hailstorms, particularly Keina Ward, Rwentobo-Rwahi and other villages in my constituency. Actually, it swept away all the onions, which our people depend on mainly in a place called Rwahi – for those who know those areas. The roof at Keina Primary School, which is a government school, was swept off by the wind. May we get immediate help, if you can, Rt Hon. Prime Minister? Thank you.

In Ntungamo District, people lack mineral information and are unsure how to sell or lease land to investors, especially after lithium discovery. Investors bypass district officials and go straight to local councils, leaving residents confused. A minister in Kajara County guides investors, making it hard for local leaders to address issues.

Thank you, Mr Speaker. I rise on a matter of national importance concerning lack of mineral information in Ntungamo District, where a number of minerals have been discovered, and lately, lithium, which is causing a lot of challenges. At the moment, people do not know how they should give out their land, either through a lease or selling it. They do not know how to deal with investors. At the moment, investors come and buy land the way they want and people do not know how much they are supposed to charge because they do not know whether they are leasing or selling their land. Secondly, these investors do not go through the district administration and political structures. They go directly to the local councils and therefore, the guidance the residents would get is not simple to attain. Another issue is that the guardian at the moment who is working in Kajara County, who is guiding investors, is Hon. Muruli Mukasa, who is a minister. Therefore, the local government leadership cannot confront the minister when they find challenges with the investors. My prayers. (Interjections) Prayer number one; the Ministry of Energy and Mineral Development should give mineral information to the people of Ntungamo District and the entire country, because most of the people do not even know how those minerals look like, and they do not know how they are supposed to deal with investors when they come to acquire land. Furthermore, the minister who is down in Ntungamo, guiding our investors should create a situation where people can get information. Liaise with the minister in charge of minerals so that people can get all the required information and develop minerals without confronting citizens in a bad way. Thank you very much, Mr Speaker.

10739 THE ELEVENTH PARLIAMENT OF UGANDA TUESDAY, 24 OCTOBER 2023 Mr Speaker, I got a rare chance – I call it “rare” because there are few here who got it – to work closely with Hon. Kyemba. To make the record clear, I came to this Parliament in the Fifth Parliament, that is the National Resistance Council (NRC). (Applause) It was not the CA. Hon. “Mama Busia” says, I am the youngest. When I came to this Parliament, Mr Speaker, I was young and just from school. Therefore, I bring condolences from the National Resistances Council, the Sixth Parliament and myself to the family and the country. When I came to this Parliament, Ntungamo had just been elevated to district status and I had just finished school. People called me and I did not even know how Members were elected to Parliament. Some people told me, “It is this and that” and I ended up coming unopposed. When I came, it was through a by-election and people would normally escort you in. People usually mistake me for having come to the CA because I came around the same time. I was here for one-and-a-half-years and we went back for elections for the Sixth Parliament. When I was brought in, Hon. Kyemba was a minister. However, despite him being a minister and me being young – and I had never seen him - he was among the few people who walked me in to the Speaker. That is why I said I was honoured and I feel happy that I can now testify about his goodness. Mr Speaker, that experience tells me a lot about what I see around me. I travelled with Hon. Kyemba to the Commonwealth Parliamentary Association Conferences. He was a diplomat and a man of good etiquette. Honourable members, especially the men, you need to emulate him. As a gentleman, when you are moving with a woman in a bus or whatever, you do not sit before a woman sits. (Laughter) You need to be gentlemen. He was a very neat and smart man. You could read it in him when you sat with him at a table. Mr Speaker, I do not want people to misunderstand me but some people do not have etiquette. When you sit at a table to eat, you need to emulate this gentleman. He was a gentleman, diplomat, neat, great and a very clever man. I knew about Rotary through Hon. Kyemba. He was a very good Rotarian. He lived and moved like a Rotarian. You would find him with neat badges every time; he was decorated. At times I would ask, “Why don’t you give me one?” He would say, “Join Rotary.” He encouraged me to join Rotary although I never joined. (Laughter) Probably, in his memory, I should join Rotary. (Applause) Mr Speaker, I benefited from him being a Rotarian. He had got some donated items – I think they were supposed to be for a certain area in Busoga. However, because he used to take me as his child in Parliament, I convinced him and he gave me very good books, which had been donated, and I took them to Ntungamo. By then, I was representing Ntungamo District. We shall miss him but he has lived a good life. As Hon. Zijjan said, he was “Mr No Scandal”. I did not know him as a scandalous person. When we had just come, we formed the Young Parliamentary Group and the qualification would be that it was either your first time to be in Parliament or you were a young person. He did not qualify because he had been in Parliament longer. However, because he associated with the young Members of Parliament, Hon. Kyemba used to move with us and advise us. Hon. Mao is there to testify. That was in the Sixth Parliament. I therefore wish him a good rest. May his soul rest in eternal peace. Thank you. (Applause)

Thank you so much, Mr Speaker. In July 2023, the Ministry of Education and Sports issued a list of secondary and primary schools chosen to be grant-aided for the Financial Year 2023/2024. In Ntungamo District, we were given three schools, that is, Ngoma Secondary School, Nyakyera Subcounty, Karambi Secondary School in Nyarutuntu and Maama Janet Girls School in Nyakyera Subcounty, with their proposed budgets of Shs 659 million for each school. We went to the Ministry of Education and Sports, confirmed with the Commissioner, made the necessary preparations and submitted the list of the requirements. On 26 September 2023, in a letter written by the Permanent Secretary of the Ministry of Education and Sports to the Public Service entitled: “Request to grant aid to 38 primary schools, 46 secondary schools in the Financial Year 2023/2024”. Ngoma and Karambi Secondary Schools are not mentioned. Ntungamo District has 34 subcounties and a population of around 580,000 people. We need primary schools. A list of five primary schools was submitted requesting grant-aiding. None of them appears on the list.

Thank you. Honourable colleagues, I can see the Members looking at each other but Ntungamo District - sometimes, I know the Members of Parliament – is unique. It has around five to six districts in it if you are to talk of an average Ugandan district. This is a problem, which the Central Government needs to look at. Service delivery based on administrative units cannot be effective. We should consider other parameters. For example, Ntungamo District getting the same quota as Mitooma District - that is cheating the people of Ntungamo. That is why there is clamour all the time; districts give us this and that. Another example is Wakiso District. As the Government, you need to have a unique way of looking at them. About the issue of schools, honourable Minister of Education and Sports; you have heard the prayers.

6211 THE ELEVENTH PARLIAMENT OF UGANDA THURSDAY, 10 NOVEMBER 2022 teacher and staff recruited by the Government to run the school. The second one is: aware that Government policy does not support boarding seed secondary schools, is there any special way Nekemia Memorial Seed Secondary School in Buuvu, Kalangala District can be opened as a boarding seed secondary school, since it is meant to serve primary schools in Kachanga, Luramba, Kotobo and Bufumira, which are all in different islands. Madam Speaker, my response is, the Education Service Commission has finalised the recruitment of 4,805 teaching and support staff for seed secondary schools. Among these are 126 head teachers and 156 deputy head teachers. The ministry has already issued appointment letters awaiting posting instructions and deployment to the various seed secondary schools, including Nekemiah. It is true that the current scope of seed secondary schools do not have boarding facilities. This is in line with the USE School Policy. However, the ministry and Government have noted the need to have exceptions for districts located in Karamoja and the islands, where operation of day schools is very challenging. Assessment is on-going by the ministry engineers to ascertain that the cost needed to provide the above facilities are budgeted for in the medium term. Question No.7 came from Hon. Naome Kabasharira, Member of Parliament, Rushenyi County in Ntungamo District. Madam Speaker, the Member says that there is a constant outcry by truck drivers plying the Kampala-Masaka- Mbarara route over the mismanagement of the Lukaya and Mbarara weighbridges and alleged misconduct of the officers in charge. Truck drivers complain of harassment and extortion by some officers in those respective weighbridge stations. This unprofessional conduct of business by the officers manning those stations may cause financial loss to the Government as the money extorted from the drivers does not reach public coffers. Her prayers are that: 1. The relevant agencies streamline the operations of the weigh bridges across the country. 2. An investigation should be conducted on the two weighbridges to establish the extent of the problem and the errant officers be prosecuted. Madam Speaker, Mbarara and Lukaya fixed weighbridges are located along the Masaka- Mbarara Road and are used to regulate the overloading of trucks for purposes of protecting the road infrastructure from premature damage. The two weighbridges are managed by the Ministry of Works and Transport through the Uganda National Roads Authority (UNRA). The Government is in advanced stages of installing the first phase of a high speed weigh- in motion system at Mbarara, Magamaga and Luweero. The high speed weigh-in motion systems for other weighbridges including Lukaya will be installed in the subsequent phases. These systems will allow compliant transporters to move on the road without having to stop on the weighbridge. Data centralisation has been done for Mbarara, Lukaya, Luweero, Magamaga, Mubende and Mbale weighbridges. This increases visibility of weighing operations at each weigh station for monitoring purposes. Madam Speaker, I would like to inform this House that the matter reported by the honourable member in Rushenyi is being followed and those officers will be brought to book. Question number eight: Hon. Naboth Namanya, Member of Parliament of Rubabo in Rukungiri District says that Kahengye Water Project commenced in 2015 with a projection to provide a lasting solution to water shortages in the constituencies of Rubabo, Rujumbura, Rukungiri Municipality and the neighbouring areas of Mitooma District.
